 Dear Sirs,
While readng the rules on Arbitration there is still one imporatant questoins as shown here.
PARTY A (China) enters into contract to purchase manufactured goods from PARTY B (Foreign)
Party B raises a claim and threatens to invalidate the goods unless PARTY A pays it extra costs which PARTY A has disputed.
Party B also refuses to consider PARTY As claim against it.
In the contract the parties agreed to Arbitration.
In such circumstances, may PARTY A file its claim and give PARTY B reasonable time to file its own If PARTY B does not turn up can PARTY A gain a judgement in DEFAULT. This is bearing in mind PARTY B is in breach of the agreement regarding amicable solutions.
If this is the case, which legal references could I refer to.

I'm asking your help. Story is the following- I bought from one chinese company, which I found on alibaba 1 original iphone, following to thir invoice. I paid in last friday to them by WU. They promise to send on the same day. On saturday they said that just sent and gave me tracking # of a parcel. On this wednesday they said that they mistaked and gave me another tracking #, aslo said that parcel was shipped on monday. I asked many times, that if they shipped, why this track# is not in EMS tracking system. They responded that EMS is woking very slowly so I have to wait for 1-2 days. Today they said that shipped only yesterday.
How do you think, is it a scam or maybe they are telling me truth? They are gold member of alibaba.

made a payment to a supplier in china for samples of $277 before placing a large order. The supplier received the mony through TT (as requested) and then said no samples would be sent as they wanted different wording on a TT, ie "payment of wages" instead of "payment for samples cards as agreed in a contract".
They also requested the repeat payment by Western Union stating the original $277 would be refunded when the 2nd pyment received.

The 100% payment was cleared/ made as per B/L by direct TT to the company for 125MT.
The container when weighed at our port has the following Weight difference b/w BL weight and actual weight
Difference in weight 125,000 - 63,600 = 61,400Kg.

I am become a member of made-in-china.com B2B website to trade with chinese commpanys whith trust and belive in honesty. My first experience during trading was total disaster.
I am recive a package via EMS from China but inside are a pair of NIKE sneakers. That I am not order and I am not payd 737 USD for a pair of ugly tennis shoes. Im order and payd Apple MAC BOOK Air 13-inch: 1.6GHZ - a computer. I am try to be very careful in business but the GG TRADE company is obviousli a fake or cheating company.
I am have documentation that you can see with whole procedure in trading. I am hope then you can tell me what can I do.
It is no matter of money I am lost. It is matter of trust in China commpanys.

If there is an arbitration clause in your contract designating our Commission to be the arbitration institution, you and the other party will be bound to submit the dispute to our Commission. If there is no arbitration clause or arbitration agreement between you and the supplier, we suggest you bring a lawsuit against the supplier. There should be an arbitration clause in your contract or PI between you and the other party, or our Commission has no jurisdiction over your trade dispute.
We also suggest you that, if you did not do it before, insert an arbitration clause in your PI or contract with the supplier in your other deals or your future purchase. Model Arbitration Clause: ?Any dispute arising from or in connection with this contract shall be submitted to China International Economic and Trade Arbitration Commission, South China Sub-Commission for arbitration which shall be conducted in accordance with the Commission's arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding upon both parties.?
