SFDRC-Mediation Procedure


1.

The parties submit their mediation application to the Resolution Centre.

 

2. 

The Resolution Centre reviews the mediation application.

 

3.

An application failing to meet  the stipulated conditions for acceptance would be rejected.

 

4.

An application that meets the stipulated conditions for acceptance would be accepted. The Resolution Centre then shall dispatch to the parties the Notice of Mediation together with the Mediation Rules, the Panel of Mediators and other relevant materials.

 

5.

The parties shall jointly appoint a mediator from the Panel of Mediators.

 

6.

Where the parties fail to jointly appoint the mediator within five working days, the mediator shall be appointed by the Resolution Centre. 

 

7.

The parties may agree to mediate by more than one mediator.

 

8.

The mediation shall be completed within twenty working days once the mediator is appointed. The parties may agree on a different time limit for mediation of their own accord.

 

9.

A settlement agreement is reached.

 

10.

No settlement agreement is reached.

The parties may, pursuant to the arbitration clause in the settlement agreement, apply to SCIA for rendering an arbitral award lawfully and quickly on the terms of the settlement agreement under its Arbitration Rules in effect of applying for arbitration. .

The parties may also apply to the people’s court for judicial confirmation according to law.

The parties may refer the dispute to SCIA for arbitration pursuant to their arbitration agreement.

The parties may also bring a lawsuit before a people’s court.
